Employment Tribunal Fees to reduce?

As we have reported and discussed many times in our blogs and seminars, there has been a seismic shift in the number of Employment Tribunal claims from before July 2013 when fees were introduced to the present. We have moved from a culture in which Employment Tribunal claims could be brought at low cost to the individual and employers might face unfounded proceedings against them, to a situation in which genuine claims cannot be heard and worker’s rights are at risk.

In November our Kate Booth gave evidence to the Justice Committee in the House of Commons about her experience of dealing with Employment Tribunal claims for both individuals and employers.

We are now awaiting the outcome of the Justice Committee’s deliberations, but it seems quite likely based on the evidence submitted from many of the parties that the Employment Tribunal fees will be reduced, which may see a rise in the number of claims brought against employers.

The extent of the increase in claims will depend largely on the changes to the fees. But as employees have a period of 3 months to bring a claim from the date of the act complained of (e.g. 3 months from the date of their dismissal, or 3 months from an allegedly discriminatory act) employers are advised to follow their employment procedures carefully whilst we await the news.
