For most people the experience of receiving medical treatment is successful.
For an unfortunate few, either the standard of treatment is not acceptable or something that could have been prevented goes wrong. Although rare, anyone can be a victim of such events. Medical accidents are often complex and demanding of specialist legal expertise.
The team at Eaton Smith is headed by Judith Schofield, an accredited member of the Law Society Clinical Negligence Panel. The department boasts many years of experience dedicated to helping victims of all types of medical accidents.
We understand that cases involving medical treatment are particularly distressing and require a sensitive and professional approach. We also acknowledge that money alone cannot compensate for major injuries but it can help to improve the quality of life for the injured parties and the carers. So if you or someone close to you has suffered an injury as a result of negligent medical care, it may be possible to make a claim.
The medical negligence team at Eaton Smith has many years of experience. They have acted successfully for many clients recovering significant damages both in and out of court from victims of negligent medical care. Some of the areas we have experience of dealing with are:
In 2001 Mr N had been suffering leg pains, had a bone scan and was told he had a non-malignant condition. Further tests revealed nothing untoward until an accidental broken leg revealed an aggressive bone tumour in the left thigh. Despite prompt surgery an amputation was the end result. The court awarded him £119,000.
A six year old boy received £1,800 because his dentist failed to diagnose decay to three teeth which then had to be extracted under general anaesthetic when he was five.
After an appendix operation Mrs L continued to suffer with unexplained abdominal pain, which lasted for nearly a year until a 3cm piece of plastic medical equipment was removed through surgery. The result was compensation of £12,000 plus a further £7,000 for financial loss.
Mr Y had a knee replacement operation in 2003 at which an artery was unfortunately damaged by accident. This was not recognised for several weeks so the condition worsened leading to a permanent leg injury. This was settled with a payment of £33,000.
