Kate is a Partner in the Employment Team and is also our Notary Public. Kate joined Eaton Smith as a solicitor in May 2010, was promoted to Senior Solicitor in April 2012 and to Associate in April 2013. Kate qualified in 2007 and, prior to joining Eaton Smith, worked with Irwin Mitchell and DWF to build her experience in employment law.

Kate leads our employment team, which is part of our Business Services Team and delivers high quality client-focussed advice with an emphasis on commerciality.

Kate has experience in advising on all areas of employment law, including:

• Drafting contracts of employment, director’s service agreements, consultancy agreements, apprentice agreements, secondment agreements, contracts for casual or temporary workers, employment policies and procedures, and staff handbooks.

• Drafting and advising on the application and enforcement of restrictive covenants.

• Dealing with internal matters such as disciplinary procedures, redundancy programmes, absence management procedures and grievances.

• Advising on the application of legislation and the entitlements of workers, including national minimum wage, working time, statutory maternity, paternity and adoption leave and pay, flexible working requests, and whistleblowing.

• Advising on aspects of discrimination including practical steps to safeguard businesses and advice for workers who have been subject to discrimination.

• Dealing with the employees affected by the sale or transfer or a business or outsourcing of a service, including advising on the implications of TUPE (the Transfer of Undertakings (Protection of Employment) Regulations 2006) and ensuring that businesses have appropriate indemnities in place to protect it going forwards.

• Dealing with the dismissal of staff and the negotiation of termination packages.

• Representing both employers and employees (or former employees) in Employment Tribunal claims.

• Negotiating termination packages (including financial negotiation and amendment of restrictive covenants) and settlement agreements (including compromise agreements and COT3 agreements).
