If you are unlucky enough to have had an accident or injury at work or in a car, in the street or as a result of violent crime - at Eaton Smith we have experienced experts who can claim compensation for you.

Our team of qualified solicitors and legal executives are members of the Law Society Personal Injury Panel and the Association of Personal Injury Lawyers. They concentrate specifically on this type of work to ensure that their training and knowledge, gained from many years experience in this area, will bring you the best possible results.

Your compensation may include payments for pain and suffering, loss of earnings and claims for expenses. Your legal expenses will be part of your claim.

Injuries which are a result of the negligence of doctors or surgeons, can have a traumatic effect. The experience, which our team has built up over years of advising clients, can help you through the difficulties.

We can arrange a number of ways to pay for your accident claim:

  • Conditional Fee agreements - no win, no fee
  • Legal Expenses Insurance - usually you can instruct us with the agreement of your insurer - if in doubt please ask
  • In certain, limited cases Legal Aid is still available for personal injury claims
  • If you are a member of a Trade Union, your union may fund the claim
  Examples

Over recent months we have concluded claims ranging from hundreds of pounds to over a million pounds. All such claims depend, of course, on the particular circumstances.

Example 1
A lady tripped in a large pothole left in the pavement by a negligent council. There were no signs or warnings. At court she was awarded £2000 for her injury.

Not all claims involve the court. Most are dealt with by negotiation and settlement.

Example 2
An employee was given insufficient training to use mechanical equipment. The equipment was unsuitable for the job in hand. As a result the employee was killed in an accident involving the equipment. His widow recovered £135,000 in compensation from the employers.

Many injuries are caused in road traffic accidents. Many involve children.

Example 3
Compensation for a family involved in a road accident included payments to the mother for whip-lash injuries, a payment into trust for a toddler injured in the same accident and payment to include compensation for the depression and other expenses all of which totalled many thousands of pounds.
